我国医疗纠纷人民调解委员会中立性问题探析

Analysis on the Neutrality of People’s Mediation Committee of Medical Disputes in China

人民调解以方便、灵活、公正等独特优势成为极具发展潜力的一种医疗纠纷调解途径,但中立性的不足很大程度上阻碍其发展。从机构、人员、调解过程和资金四个主要方面就现存问题及如何保障医调委的中立性进行介绍和讨论,分析其运行现状和效果,发现目前医调委与行政部门、保险公司和医院依然存在关联性,暂未能保障该机构的完全独立和中立。就此,提出通过对社会公开招聘形成专业人才团队,强调调解程序的规范和重要原则的实现,以及国家财政部门设立专项资金等措施,保障医调委的中立性,探究更加合理完善的医调委发展路径。

In recent years,people's mediation has become a medical dispute mediation channel with great development potential due to its unique advantages,such as convenience,flexibility,and justice,but its lack of neutrality has largely hindered its development.This article introduces and discusses the existing problems and how to ensure the neutrality of the medical mediation committee from four main aspects of institutions,personnel,mediation process and funds.It analyzes the current status and effect of the operation,and finds that the current medical mediation committee and the administrative department,insurance companies and the hospital still have affiliation,and for the time being it cannot guarantee the institution's complete independence and neutrality.In this regard,this article proposes the formation of a professional talent team through open recruitment of the society,emphasizing the realization of norms and important principles of the mediation process,and the establishment of special funds by the state financial department to ensure the neutrality of the medical mediation committee,with a view to exploring more reasonable and comprehensive medical practices.
