对作为经验的欧美人类种系基因编辑立法的省思

Europe and America as an experience: Reflections on the Legislation of Human Germline Gene Editing

面对人类种系基因编辑带来的伦理争议,如何借鉴西方立法经验受到重视。欧美国家的制度经验主要立足于其自身的文化传统和伦理情境。是否需要将人类种系基因修饰视为禁忌,有待于商榷。更重要的是,西方的伦理及法制经验的"普遍主义"和"地方性"还需要进一步讨论。

In the face of the ethical controversy brought about by human germline gene editing,the experience of Western legislation is valued.But Western institutional experience is based on its own cultural traditions and ethical contexts.Whether it is necessary to treat human germline genetic modification as a taboo is yet to be discussed.More importantly,Western ethical and legal experience should be regarded as“universal standards”or“local knowledge”,which is worthy of discussion.
