中国区域经济法制模式探索与路径创新——以政策补强型法制为路径

Exploring China’s Regional Economic Legal System and Innovating Its Path: Taking the Policy Reinforcement Legal System as the Path

文章以改革开放40多年来我国区域经济法制建设为研究对象,通过对"提速式""法律政策化""软法包容"与"冲突法"四类法制模式的反思,总结出我国区域经济法制的实现条件,提出"修正区域经济政策固有缺陷的补强路径才是契合我国实际的区域经济法制建设现实路径"的观点。文章称其为"政策补强型"法制路径,其实质为工具理性与价值理性共同主导下政策与法制的良性互动。在现行立法框架下,地方协同立法"由内到外"补强与国家立法"自上而下"补强两种法制建设模式是弥补区域经济政策"领导力与执行力不足"的具体途径。

Taking the development of the regional economic legal system in the first 40 years of China’s reform and opening up as the object of study, this paper reflects on the four legal models of "speeding up", "legal policy", "soft law tolerance" and "conflict of laws". It sums up the conditions for the realization of the regional economic legal system in China, and holds that "the way to make up for the inherent defects of the regional economic policy is the realistic path to develop the regional economic legal system in line with the reality of our country". This paper calls it the "policy reinforcement" legal path, and its essence is the benign interaction between policy and legal system under the mutual guidance of instrumental rationality and value rationality. Under the current legislative framework, local coordinated legislation reinforces laws "from the inside to the outside" and state legislation improves them "from top down". These are concrete ways to make up for the lack of leadership and executive power of regional economic policy.
