我国赦免制度的规范与完善——基于中国传统和域外经验的比较考察

The Nomalization and Perfection of the Amnesty in China ——A Comparative Study Based on Chinese Traditional and Foreign Experience

完善赦免制度应符合中国国情,这就需要坚持立法的弹性原则、适用对象的广泛性原则和赦免方式的多样性原则。法典化的赦免立法不适宜当代中国,基于政治、外交、庆典的赦免宜采取随时定制的方式而不宜预先定型。随中国步入社会主义新时代,未来宜逐步扩大赦免的范围,建立生命刑、财产刑、资格刑的赦免制度,并通过增设赦免性减刑、赦免性假释丰富赦免的措施体系,以便更加灵活地运用赦免制度。

To improve the amnesty system should conform to China’s national conditions,we should adhere to the principle of flexibility of legislation,the principle of universality of applicable objects and the principle of diversity of amnesty modes in order to improve the amnesty system.Codified pardon legislation is not suitable for contemporary China.And pardons based on politics,diplomacy and celebration should be customized at any time instead of pre-defined.As China enters a new socialist era,it is advisable to gradually expand the scope of amnesty in the future,establish the amnesty system of life penalty,property penalty and qualification penalty,and enrich the measure system of Amnesty by adding amnesty commutation and parole,so as to make more flexible use of the amnesty system.
