乡村振兴战略下土地确权的问题和对策——基于佃农理论的分析 被引量:3

摘要 按照佃农理论的阐释,土地确权降低了交易成本,提高了土地资源的收益率和地租收入,进而保障了农民的利益。但随着我国土地确权改革进程的不断加快,土地确权登记和流转中存在的宅基地使用权权属不清、土地承包经营权存废存在争议、集体建设用地使用权无序流转等问题逐渐显现,为此应保障农民在土地确权中的合法权益,统一土地确权的登记部门,明确确权主体和性质,并且完善土地确权登记流程,加强专业队伍建设。 According to the interpretation of Tenant Theory,confirmation of land right reduces transaction cost,increases the rate of return on land resources and rent income,and thus protects the interests of peasants.However,with the accelerating reform of confirmation of land right in China,the problems including unclear ownership of right to use homestead,dispute on the existence or abolition of land contractual management right,and disorderly transfer of the right to use collective construction land in the process of registration and transfer gradually emerge.To this end,it is necessary to protect the legitimate rights and interests of peasants in the confirmation of land right,unify the registration departments of confirmation of land right,clarify the main body and nature of the rights,and improve the registration process and strengthen the construction of professional teams.
