摘要
现阶段,世界上非专职化法官参与司法过程存在三种典型模式:英国的治安法官制度、荷兰的替补法官制度以及日本的裁判员制度。由于轻微刑事案件司法理念和司法操作要求与非专职化法官制度存在着高度的契合性,我国可以考虑在轻微刑事案件的处理过程中引入非专职化法官制度。可先选择具有法学教育背景的高校教学科研人员或者律师作为非专职化法官,待成熟之后,再扩及到普通公众,由此既能节约司法资源快速处理案件,又能够做到民意在司法过程中的合理参与。
There are there typical modes of non-professional judges around the world: lay justice of England, substitute judge of Netherlands and saiban-in seido of Japan. Since the judicial philosophy and practice demand of minor criminal cases have highly similarities with non-professional judge system, it is possible to introduce non-professional judge system into minor criminal cases solving. Suggestions are choosing lawyers and college teachers who have law education background as non-professional judges at the first, then expanding to the normal people. Not only can this way save judicial sources in solving minor criminal cases fast, but also it can realize the reasonable participation of public opinions through the judicial process.
