论城市机动车常态化限行的法律属性

摘要 我国的机动车保有量迅速攀升,对道路和环境产生很大的压力。多个城市纷纷出台了对机动车限行的规定,确实有效减少了道路拥堵的情况,空气质量也有所好转。但是机动车限行是否侵犯了公民的私有财产权,在专业领域引发了相应讨论。常态化的区域限行不属于行政许可、行政强制和行政征收,而属于管制性征收。在机动车限行中,公民对机动车的所有权并未丧失,但是对机动车的使用权并不能按照自己的意志使用,需要按限行规定进行行驶,产生了购买价值上的贬损。 The number of motor vehicles in our country is rising rapidly, which puts great pressure on roads and the environment. A number of cities have issued restrictions on motor vehicles, which have effectively reduced road congestion and improved air quality. However, whether motor vehicle restrictions infringe on citizens ’private property rights has caused corresponding discussions in the professional field. The normal regional restrictions do not belong to administrative permission, administrative coercion and administrative expropriation, but to regulatory expropriation. In the motor vehicle restrictions, citizens have not lost their ownership of motor vehicles, but the right to use motor vehicles cannot be used according to their own wishes. They need to drive according to the restrictions and regulations, resulting in a derogatory purchase value.
