贪污贿赂犯罪人在外部身份和主观心理方面具有独特的、不同于其他犯罪人的特征。外部身份特征为年龄因素普遍影响职权的获得、教育因素的社会分层功能影响犯罪的类型、女性的贪污贿赂犯罪不容忽视、主体的身份与政策的倾向密不可分、国家权力层级上的贪污贿赂犯罪人有所增加。主观心理特征为罪责感丧失、信仰缺失、自我认知偏差、自律缺乏。绝对权利、腐败群体亚文化、家庭因素和低收入水平影响贪污贿赂犯罪人主观心理特征的形成。在防治上需要从多个层面推进相关法律制度的完善。

In terms of external identity and subjective psychology,corruption and bribery criminals have unique characteristics that are different from others.The external identity factors are as followed.Age generally affects the acquisition of authority and social stratification of education factors influences the types of crimes.The characteristics include considerable female corruption cases,close relationship between subject identity and policy and an increasing number at the level of state power.On subjective psychological,the characteristics include the absence of guilt feelings,lack of belief,self-cognition deviation and short of self-discipline,which are formed by the absolute power,corrupt subculture,family background and low income level.As for its prevention and treatment,the improvement of relevant legal system from multiple levels is of great significance.
