摘要
我国目前已经成立的五个著作权集体管理组织,全是总部设在北京、各省均不设分支机构、收费由指定的代理人进行、与各省市无关的一种只有"一个积极性"的"垄断"组织。当前,其已暴露出严重的弊端:一是覆盖面窄,中下层权利人意见大;二是著作权人利益得不到保障;三是决策常常脱离当地实际,导致作品使用者情绪对立,失误的情况也时有发生;四是重收费轻服务,导致作品使用者不满意。对此,笔者建议在各省市设立一个由当地政府直接管理的事业单位性质的集体管理机构,统一负责并成立各集体管理组织对应的分支机构,并统一管理各集体管理组织在本省市的作品使用费收缴工作。
At present,there are five copyright collective management organizations established in China,and all of them are located in Beijing,which means no branches are established in each province.The fees are collected by designated agents.They only have"one initiative"and they are the type of"monopoly"organizations that have no relationship with any provinces or cities.Nowadays,as the matter of fact,it has exposed serious drawbacks.Firstly,the coverage is narrow,which makes the middle and lower rights holders greatly dissatisfied.Secondly,the interests of copyright owners are not guaranteed.Thirdly,decision-making is often far away from the actual local situation,leading to emotional opposition of the users of the works,and the occurrence of mistaken cases now and then.Lastly,paying attention to charging royalty fee and ignoring service lead to the dissatisfaction of the users.Therefore,the author proposes to set up a collective management institution that is directly managed by the local government in each province or city,who will be responsible for the establishment of branches corresponding to each collective management organization,and to unify the administration of collective management organizations in terms of the collection of copyright royalties.
