科学证据在检察机关公益诉讼中的运用

The Application of Scientific evidence in Public interest Litigation of Procuratorial organs

检察机关公益诉讼案件涉及到多个公共领域,其中需要专业性证据证明案件事实的地方不得不运用科学证据。科学证据运用过程中出现了运用成本高、耗时长、行业中缺乏统一的标准和证据的信服程度不足等问题。为了解决这些问题,应从多方面切入,不仅检察机关需完善自身的做法,还应与其他相关部门联合形成统一的标准,采用降低科学证据成本的方法,进一步完善科学证据在检察机关公益诉讼中运用的规则。

The public interest litigation cases of procuratorial organs involve many public fields,among which scientific evidence has to be used where professional evidence is needed to prove the facts of the case.In the process of using scientific evidence,there are some problems,such as high cost,long time consuming,lack of unified standard and insufficient convincing degree of evidence in the industry.In order to solve these problems,we should cut into it from many aspects.Not only the procuratorial organs need to improve their own practices,but also they should form a unified standard with other relevant departments,adopt the method of reducing the cost of scientific evidence,and further improve the rules used by scientific evidence in public interest litigation of procuratorial organs.
