摘要 人工智能新闻已经在实践中得到广泛应用,取得了积极的成效。然而,在著作权的保护上,人工智能新闻面临着创作主体资格障碍、独创性难以准确判断、权利归属不清等问题。人工智能已深入到作品的创作领域,应将以自然人为标准转化为以作品受众为标准构建作品与创作主体之间的关系,从而使创作主体与权利主体区分开来,以应对新技术的发展,解决人工智能创作主体资格问题。人工智能新闻独创性的判断标准在于是否基于现有的存量要素的基础上新增了增量要素,如果增加,那么增量要素即是其独创性的体现。在现有的法律框架下,人工智能新闻权利应归属于最终使用者,一方面可以避免人工智能自主生成的作品与利用计算机辅助生成作品进行区别;另一方面也有着较为切实的实践意义。 Artificial intelligence news has been widely used in practice and has achieved positive results.However,in the protection of copyright,artificial intelligence news faces the problems of qualification barriers for creation subjects,difficulty in accurately determining originality,and unclear attribution of rights.Artificial intelligence has been applied into the field of creation of works.The relationship between the works and the creation subject should be based on audience-oriented standard instead of natural person-oriented standard in order to distinguish the creation subject from the right subject,and to cope with the development of new technologies.It can qualify the subject for artificial intelligence creation.The criterion for the originality of artificial intelligence news lies in whether or not incremental elements are added to the existing stock elements.If it adds,then the incremental element embodies its originality.Under the existing legal framework,the rights of artificial intelligence news should be attributed to the end users.On the one hand,it can avoid the necessity of distinguishing between artificially generated works and computer-aided produced works;On the other hand,it is of practical significance.
