公安内部执法监督机构的产生、发展与改革

The Emergence, Development and Reform of the Internal Law Enforcement Supervision Institutions of Public Security

建国以来,公安监督工作适应不同历史时期国家和社会发展的需要逐步形成了以法制部门作为主管部门,政工、纪检、督察、审计、信访等职能部门分享不同监督职能的多元主体并立的内部执法监督体制。不过,由于存在监督“碎片化”问题,目前的监督体制并没有充分发挥监督效用。因此,在依法治国方略全面推进实施、公安改革全面深化的当下,应当综合考虑党性逻辑、控权逻辑和治理逻辑三种理论进路,以《中华人民共和国人民警察法》中“督察”条款为核心,理性构建公安内部执法监督机构。

Since the founding of the People’s Republic of China,the supervision work of the public has adapted to the needs of national and social development in different historical periods.The internal legal supervision has been gradually formed with the legal department as the competent department,and the functional departments such as political work,discipline inspection,supervision,auditing,and letters and visits share different supervisory functions.However,due to the problem of“fragmentation”of supervision,the current monitoring system has not fully exerted its supervisory utility.Therefore,in the current situation of comprehensively promoting the implementation of the country according to law and comprehensively deepening the reform of public security,we should comprehensively consider the three theories of party logic,power control logic and governance logic,and take the“inspection”clause of the“Police Law”as the core to rationally construct internal law enforcement supervision agency of public security.
