Research on the Law Enforcement System of Public Security Organs

公安机关现场执法活动呈现出执法环境恶化、执法权威弱化、执法问题泛化的特点,以《公安机关现场执法指引》为研究基础,详细阐述了其颁布的“四维”价值,从健全现场执法基本要求、更新现代警务实战理念、界定武力优先使用等级、规制现场执法操作流程、增配现场执法的豁免权等五个方面入手,力求探析出破解公安机关现场执法困境的现实路径,从而促使公安机关现场执法制度趋于完善。

The law enforcement activities of the public security organs shows the deterioration of the law enforcement environment,the weakening of law enforcement authority,and the generalization of law enforcement issues.Based on the“Guidelines for On-the-spot Law Enforcement of Public Security Organs”,this paper elaborates on the“Four-dimensional”value promulgated by it,from the basic requirements of sound on-site law enforcement,the update of modern police practical concepts,the definition of the priority use of force,and the regulation of on-site law enforcement operations.In addition to five aspects of the exemption of on-site law enforcement,the author tries to explore the realistic path of cracking the on-site law enforcement dilemma of public security organs,thus promoting the improvement of the on-site law enforcement system of public security organs.
