在当代社会,环境污染和生态破坏引发的环境健康问题①愈发突出,使得有效规制环境健康风险成为重要议题。为确保风险规制措施的合理性与合法性,风险预防原则在制度建构过程中应特别注重科学性和规范性的有效实现。为此,应实行弱风险预防原则,明确风险程度和风险等级,实现价值与理性的衡平适用。在此基础上,通过健全政策基础,完善技术基准,加强项目管理和司法救济机制,将风险预防原则融汇于环境健康风险法律规制之中。

In modern society,environmental pollution and ecological damage have a severe impact on human society,and environmental health problems have thus become increasingly prominent,making effective regulation of environmental health risks an important issue.In order to ensure the rationality and legitimacy of risk regulation measures,the precautionary principle should pay attention to the effective realization of scientific and normative in the process of institutional building.To this end,the principle of weak precautionary principle should be implemented,the degree and the level of risks should be clarified,and the equivalence between value and rationality should be applied.On this basis,through the improvement of the legal system,the precautionary principles are integrated into the environmental health risk legal regulation.
