摘要
微电影行业的迅猛发展带来的是法律风险的增加。作为广告与电影中间产物的微电影,既有广告的许多特征,又具有电影的基本特点,但作为一个新生事物,微电影从剧本、融资、内容、制作、片酬到传播又实现了广告商追求盈利的目的。本文从微电影的产生及发展历史出发,对微电影领域存在的法律风险问题进行探究,以期通过法律规制和行业规范使微电影得到良性发展。
The rapid development of microfilm industry brings about an increase in legal risks. As an intermediary product of advertisement and film,micro-film not only has many characteristics of advertisement,but also has the basic characteristics of film.However,as a new thing,it achieves the advertiser’s goal of pursuing profit from script,financing,content,production,film remuneration to dissemination. Starting from the history of the emergence and development of microfilm,legal risks existing in the field of microfilm are analyzed to promote the development of the micro-film through legal regulation and industry standard.
