摘要
目前,立法上关于教育惩戒权的内容较为笼统,导致这一权力难以获得规范行使。教育惩戒权内含鲜明的教育价值,对其进行详细的立法规定成为此次《教师法》修订工作的重要任务。《教师法》应在明确教育惩戒权基本原则的基础上,界定这一权力的概念及种类等规范意涵,确保立法的可操作性。《教师法》亦应构建教育惩戒权的监督机制,其具体含纳校内申诉机制与政府申诉机制两种类型。
At present,the content of the power of educational punishment in legislation is relatively general,which makes it difficult to effectively exercise this power.The power of educational punishment contains distinct educational value.It has become an important task for the revision of Teachers Law to specify this power in detail.On the basis of defining the basic principles of this power,Teachers Law should define the concept and types of this power,and ensure the operability of the relevant provisions.Teachers Law should also construct a supervisory mechanism,which includes two types of appeal mechanism in schools and government.
