我国亲属制度改革的进展、问题与对策——《民法典婚姻家庭编(草案·三审稿)》述评

The Progress, Problems and Countermeasures of the Reform of Kinship Systems in China——A Review of the Marriage and Family Volume of the Civil Code of PRC (Draft·Third Review)

我国现行婚姻家庭制度是脱离当代市场经济社会基础、落后于时代的亲属法。在改革开放已经40年的今天,编纂民法典的婚姻家庭编,为改革我国亲属法提供了机会。《民法典婚姻家庭编(草案·三审稿)》在现行婚姻家庭制度的基础上,进行了较多的改进,但是还存在较多问题,没有全面反映时代发展的要求。在对《婚姻家庭编草案》的进一步修改中,应当统一立法思想,确定民法典尤其是亲属法是私法、是权利法,而不是管理法,建立完整、科学的亲属制度,给人民行使身份权利以更多的选择,实现日益增长的美好生活需要。

The current marriage and family regulations in China break away from the contemporary social foundation of the marketing economy and lag behind the times.After 40 years since the beginning of the reform and opening-up,the compilation of the Marriage and Family Volume of the Civil Code of PRC provides an opportunity to reform the kinship law in China.The Marriage and Family Volume of the Civil Code of PRC(Draft·Third Review)has made many improvements on the basis of the current marriage and family regulations,while it still has many problems and can t fully reflect the requirements of the times.In the further revision of the Draft of Marriage and Family Volume of the Civil Code of PRC,it is necessary to unify legislative thoughts and confirm that the Civil Code of PRC,especially the kinship law,is a private law and a law of rights,rather than a management law,so as to establish a complete and scientific kinship system,providing more opportunities for Chinese people to exercise their rights and achieve their growing needs for a better life.
