网络社会治理的法治化是社会治理现代化的必然选择。我国目前的网络社会法治建设存在立法层级低、滞后性明显、权利义务不明确、缺乏政府引导等问题,互联网立法应当坚持遵循技术规律、适当规范、多方共管三原则,在提高立法层级、提升立法技术、加强政府引导、规范行业自律的基础上,运用大数据技术对网络法治活动提供辅助支撑,全面完善我国互联网法治建设。

The rule of law in netw ork social governance is the inevitable choice of the modernization of social governance. There are problems in China’s current rule of law in netw ork society,such as low legislative level,obvious lag,unclear rights and obligations,lack of government guidance,etc. Internet legislation should adhere to three principles of technology rule,proper regulation and co-management of multi-party,based on the improvement of legislative level,the promotion of legislative techniques,the strengthening of government guidance and the regulation of industry self-discipline,use big data technology to provide auxiliary support for netw ork rule of law activities,and comprehensively improve the law construction of Internet in China..
