摘要
数字经济时代,价格不再是竞争分析的唯一维度,产品质量、服务等非价格维度出现在反垄断分析框架的视野内。如何应对数据驱动型并购所引发的隐私风险,是目前竞争执法机构在进行反垄断分析时所面临的一个挑战。文章考察大数据对竞争法的影响,就隐私保护是否应当纳入反垄断分析框架这一争议,梳理当前学界观点,并且分析国外竞争执法机构在数据驱动型并购案件中对该问题的态度与处理方式。通过对域外相关理论和执法现状的研究,就反垄断审查如何应对隐私风险问题尝试提出可供参考的解决方法,并且分析了其可行性以及不足之处。
In the era of digital economy,price is no longer the only dimension of competition analysis.Product quality,service and other non-price dimensions appear in the view of anti-monopoly analysis framework.How to deal with the privacy risks caused by data-driven mergers and acquisitions is a challenge that competition enforcement agencies currently face when conducting antitrust analysis.This paper investigates the impact of big data on competition law,sorts out the current academic views on whether privacy protection should be included in the anti-monopoly analysis framework,and analyzes the attitude and treatment of foreign competition law enforcement agencies on this issue in data-driven cases.Based on the study of relevant theories and the current situation of law enforcement outside China,this paper tries to put forward some solutions for anti-monopoly review on how to deal with privacy risks,and analyzes its feasibility and shortcomings.
