On the Nature of Permanent Residence Control

外国人永久居留管理是移民管理的重要内容,永久居留管理的行为性质是移民理论体系的有机组成部分。在我国,外国人永久居留管理行为的基本属性始终处于不明朗状态,存在国家行为与行政行为、行政许可与行政确认的理论争议,不能对立法和执法实践起到很好的指导作用。在辨析国家行为与行政行为、行政许可与行政确认差异基础上,分析得出外国人永久居留管理行为属于行政行为体系中的行政许可行为的结论,并为外国人永久居留立法的完善提供理论基础。

Permanent residence control plays important roles in today’s immigration control.And the nature of permanent residence control is an important part of immigration theories.But we are still unaware of its nature.There is controversy not only between state act and administrative act,but also between administrative licensing and administrative affirmation.As a result,it can’t put the immigration practice under the guidance of theory better.On the basis of discriminating between state act and administrative act,as well as administrative licensing and administrative affirmation,this article draws the conclusion that permanent residence control is a kind of administrative act,or rather,administrative licensing.Then it may provide basic direction and theoretical support to the improvement of permanent residence control legislation.
