环境法视角下的遗传资源信息保护

Protection of Genetic Resources Information in the Perspective of Environmental Law

生物遗传资源负载着物品使用价值、生态功能价值等显性价值,也负载着遗传信息的代际传递等隐性价值。其中,"遗传资源信息"是遗传功能的关键所在,也是遗传资源保障的核心需求。但现行的知识产权制度和物权制度对遗传资源信息的保障有所缺失。在环境法的视角下审视遗传资源信息的保护,能够补充私权保障制度的缺失,体现对环境正义的价值追求,发挥环境法的保障优势。

Biological genetic resources not only carry the explicit value of use function and ecological function, but also carry the implicit value of genetic information transfer function. The genetic resources information(GRI) is the key to the genetic function of biological resources, and also manifests the fundamental requirement of genetic resource protection. However, the system of intellectual property right and real right are not enough to guarantee the protection of GRI.Nevertheless, environmental law can fill the incompetent of the system of private right, embody the value pursuit of environmental justice, and give full play to the advantages of environmental law.
