摘要
互联网时代下,网络购物已然成为人们生活中不可分割的部分,网络在给我们带来便利的同时,网络交易环境也乱象迭生。近些年爆出的淘宝、京东假货事件,极大损害了消费者的合法权益,表面上是不良商家的知假卖假行为,实质上严重暴露出产品质量监督的问题。本文将从《中华人民共和国消费者权益保护法》与《中华人民共和国产品质量法》中关于产品质量相关规定进行分析,并提出网络交易环境经济学分析--以柠檬市场效应为例,最后提出对于完善网络交易环境下的产品质量监督的立法或其他举措的可行性分析。
In the internet era,online shopping has become an integral part of people’s lives. While the network brings us convenience,the online trading environment is also chaotic. In recent years,Taobao and Jingdong fake incidents have greatly damaged the legitimate rights and interests of consumers. On the surface,it is the behavior of bad businessmen to know and sell fake goods. In essence,it seriously exposes the problem of product quality supervision. The author will analyze the relevant provisions on product quality in Consumer Rights and Interests Protection Law and Product Quality Law,and put forward the economic analysis of network trading environment. Take lemon market effect as an example,and finally put forward the feasibility analysis of legislation or other measures to improve product quality supervision in network trading environment.
