新形势下知识产权行政复议工作科学发展思路探讨

An Exploration on the Scientific Development Thinking Concerning Intellectual Property Administrative Review under New Circumstances

在行政纠纷多发和法治政府提速建设的新形势下,我国进一步提出创新驱动发展、知识产权强国建设等战略部署,对知识产权行政复议工作提出了新要求。目前,我国知识产权行政复议制度还存在行政复议制度功能定性不准确、组织机构设置不科学、复审功能模糊及复议工作人员数量和专业性不足等问题,影响着我国知识产权行政复议工作的顺利展开。知识产权行政复议工作的科学发展需要从更加宏观、系统科学的思路进行探讨。

In light of the high occurrence of administrative disputes and fast construction of the law-based government,China puts forward a series of strategic deployments,such as innovation-driven development and construction of intellectual property power,which raises new requirement for the work of intellectual property administrative review.Currently,the Chinese intellectual property administrative review system still faces such challenges as the functional uncertainty of the administrative review system,unscienti fic organizational structure settings,vague function of the review,and insu fficient number of professional review sta ffs,all of these factors are negatively impacting the successful rolling out of the administrative review work in the intellectual property field.The exploration of scienti fic development of the administrative review work in relation to intellectual property should be carried out in a broader,more scienti fic and systematic line of thinking.
