拍卖方式下的专利价值影响因素研究

On the Influencing Factors of Patent Value under Patent Auction

[目的/意义]面对大量的专利发明,企业如何去识别高价值的专利,一直是重要课题。专利拍卖市场具备开放、流通、公开等特点,通过专利拍卖,将专利价值放在一个公开透明的市场中进行衡量,可直接对专利价值进行评估。[方法/过程]基于专利的价值指标,以台湾地区某研发机构所持有且拿出来拍卖的专利为研究对象,对比分析拍卖成功的专利和未拍卖成功的专利,最后进行Probit回归,进一步识别价值较高专利具备的显著特征。[结果/结论]研究发现专利原创性、专利普适性、H指数均对专利价值有正影响;专利向后引证数、发明人的数量、权利要求数对专利价值有负影响;专利家族对专利价值的影响并不显著。

[Purpose/Significance]Facing a large number of patented inventions,how to identify high-value patents has always been an important topic in patent value analysis.The patent auction market has the characteristics of openness,circulation,and so on.Through patent auctions,the patent value is measured in an open and transparent market,so the patent value can be directly evaluated.[Method/Process]Based on value indicators that reflect the characteristics of the patent,taking the patents held and auctioned out by a research and development institution in Taiwan as the research objects,the research compares the patents successfully auctioned with the ones unsuccessfully auctioned.Through performing the Probit regression,the distinctive features of higher value patents are further identified.[Result/Conclusion]The research finds that patent originality index,patent generality index,and H index all have a positive impact on patent value;backward citations,numbers of patent inventors and patent claims have a negative impact on the value of patents;the impact of patent family on patent value is not significant.
