论地方立法后评估的实践困境与出路

The Practical Dilemma and Outlet of Post-legislation Evaluation

地方立法后评估制度是检验地方性法规或规章的民主性、科学性和实效性的重要方式。近年来我国的立法后评估工作逐渐得到重视,但仍在指导办法的内容规定、评估主体的选择、评估对象的筛选标准和评估结论的转化上存在一定问题。应当由全国人大常委会制定地方立法后评估办法,建立分散模式下的政府机关自行或委托第三方进行评估的模式,并完善评估对象的筛选标准,使评估结论得到实质性运用,从而提高立法水平。

The post-legislative assessment system is an important way to test the democratic,scientific and effective of local regulations.In recent years,China’s post-legislative evaluation work has gradually gained attention,but there are still some problems in the content regulation of the guidance method,the selection of the evaluation subject,the screening criteria of the evaluation object,and the transformation of the evaluation conclusion.The Standing Committee of the National People’s Congress should formulate a post-legislative assessment method,establish a model for the government agencies to conduct evaluations by themselves or by entrusting third parties under the decentralized model,and improve the screening criteria for the assessment targets so that the assessment conclusions can be used substantively,thereby improving the legislative level.
