比特币的法律规制研究

Research of the Legal Regulation on Bitcoin

随着比特币在我国金融领域逐渐活跃,其特有的去中心化、隐秘性等特征使得越来越多的投资者认可其内在价值。比特币法律属性不明确、价格涨跌不定等弊端对个人、国家和法律都提出了新的挑战。我国应当尽快在立法方面,明确比特币法律属性,构建比特币相关立法体系;司法方面,重新探索司法预警机制,完善相关司法保护体系;执法方面,强化比特币交易平台监管,构建技术驱动性监管体系,建立起具有中国特色的比特币法律体制。

As Bitcoin becomes more and more active in China's financial field,its unique features such as de-centralization,secrecy,etc.has made more and more investors recognize its intrinsic value.Bitcoin's legal attributes are unclear and prices are volatile,which has posed new challenges to individuals,countries and laws.China should define the legal attributes of Bitcoin in the law as soon as possible,and build the relevant legislative system;it should re-explore the judicial precaution mechanism for the use of Bitcoin,and optimize the relevant judicial protection system;as for the law enforcement,the government should strengthen the supervision on the Bitcoin trading platform,build a technology-driven supervision system,thus establish a legal system with Chinese characteristics for Bitcoin.
