伴随着事业的发展,高职院校与各类经济主体之间的经济往来愈发密切,涉及的合同种类繁多,复杂性也随之增加,因此合同管理的风险控制愈发重要。合同风险识别与评估是合同风险控制的关键所在,控制风险的前提是识别风险。合同的立项、文本起草、审批、使用印章、传递、执行(含变更、违约、解约)、存档等各个环节均存在相应的风险。识别与评估合同各环节存在风险后,需找到各环节产生风险的根源,从合同管理制度、合同管理的技术手段、合同管理的部门分工与人员配备等多个角度实施相应的控制措施,从总体上控制合同运行的状态与风险,进而从源头上或制度上确保高职院校合同风险的可控。

With the development of the higher education cause,the economic exchanges between higher vocational colleges and various economic entities are becoming more frequent,the types of contracts involved are increasing,and the complexity is also increasing.Therefore,the risk control of contract management is becoming increasingly vital.Contract risk identification and evaluation is the key to contract risk control.The prerequisite for controlling risk is to identify the risk.Risks exist in all aspects of contract making,including project establishment,contract drafting,program approval,use of seals,transmission,execution(involving changes,breach,and termination of contract),and archiving.After identifying and evaluating the risks in each link of the contract making,it is necessary to find the root cause of the risks in each link,and implement corresponding control measures from multiple perspectives,such as the contract management system,the technical means of contract management,and the division of labor and staffing of the contract management department,so as to control the status and risks of contract operation,and to ensure the contract risks in vocational colleges under control from the source or by the system.
