语言精确,逻辑严密,表达意思唯一,不存语言歧义是立法技术的基本要求。劳动合同法在立法语言、法条逻辑等方面均存在诸多细节性瑕疵,造成理论界和实务界对法条的不同理解,导致司法部门和劳动行政执法部门司法和执法的不统一,损害法律权威。在对劳动合同法进行微观审视基础上提出技术性修改建议是目前该法修改完善的现实路径。

The precise language,strict logic,unique expression meaning and no language ambiguity are the basic requirements of legislative technology.Labor Contract Law has many detailed defects in legislative language and legal logic,which results in different understandings of the law between theoretical and practical circles,and leads to the inconsistency of judicial and law enforcement between judicial departments and labor administrative law enforcement departments,and thus seriously damages the legal authority.On the basis of micro-examination of the Labor Contract Law,technical amendment suggestions are the realistic way to improve the amendment of the Law.
