论行政监管视域下共享经济法律制度的构建

On the Construction of the Legal System for Sharing Economy From the Perspective of Administrative Supervision

共享经济作为一种新生的创新商业模式,极大地促进了当下中国经济体量的发展的同时,也会出现诸如市场失灵、负外部性等问题,使得行政监管制度无法满足对新兴经济发展的有效规制。在缺乏相适应的法律框架下,各级政府往往对是否支持此种不确定性的商业形态存在争议。在共享经济极大促进中国经济发展的状态下,应当肯定其给予消费者的积极价值,政府应出台相应的创新政策对其予以鼓励,并构建相应的行政监管制度促使共享经济更好地发挥兴利除弊之功能。

As a new innovative business model,the sharing economy has greatly promoted the development of China’s economic volume.At the same time,there will be problems such as market failure,negative externality and so on,which make the administrative supervision system unable to meet the effective regulation of the development of emerging economy.In the absence of a suitable legal framework,governments at all levels often dispute whether to support such uncertain business forms.Under the condition that the sharing economy greatly promotes the development of China’s economy,we should affirm its positive value to consumers,the government should issue corresponding innovation policies to encourage it,and build corresponding administrative supervision system to promote the sharing economy to better play the function of promoting advantages and eliminating disadvantages.
