网络虚拟财产具有经济价值和精神价值,合法的网络虚拟财产可以继承。虚拟财产的人格性要求既有效保护被继承人的隐私,又兼顾继承人的利益。当隐私仅涉及被继承人个人利益,而被继承人不希望继承的,虚拟财产不予继承。人格利益型虚拟财产由与其具有密切关系的亲属继承,继承人不受上述顺序的限制。人格性虚拟财产可复制的,遗产可采用复制的处理方式,虚拟财产服务商可以收回控制该财产的账户。网络虚拟财产的存续依赖于服务商的媒介,服务商对继承人的继承具有配合义务,并对继承人提交的继承申请及证明材料负有形式审查义务。
