我国未成年人法律体系的现状、问题及完善构想

Status,Problems and Improving Ideas of the Juvenile Legal System of Minors in China

当前,中国特色的社会主义法律体系已经初步建成,覆盖民事、行政、刑事的未成年人法律体系已初具规模,为未成年人合法权益的保护提供了法律支持。然而,我国社会仍处于转型期,随着经济社会的快速发展,未成年人保护和犯罪预防工作面临许多新的挑战和难题,表现在宏观上未成年人法律体系的顶层设计不尽完善;中观上未成年人法律体系的协调性较差;微观上未成年人法律体系的操作性较弱。因此,必须以未成年人最大利益原则为出发点,深化未成年人法律保护的体系理念,确立科学的未成年人法律体系模式,完善未成年人法律体系建设的具体路径。

At present,the socialist legal system with Chinese characteristics has been initially established,and the legal system for minors covering civil,administrative and criminal affairs has beguan to take shape,providing legal support for the protection of the legitimate rights and interests of minors.However,our society is still in the transition period.With the rapid development of economy and society,protection of juvenile and crime prevention are facing many new challenges and problems.For example,the top-level design of the legal system of minors is incomplete on the macro level;the coordination of the legal system of minors is poor on the meso level;the operation of the legal system of minors is weak on the micro level.Therefore,we must take the principle of the best interests of minors as the starting point,deepen the concept of legal protection system for minors,establish a scientific legal system model for minors,and improve the specific path of the construction of legal system for minors.
