刑事案件证明的过程在本质上是一个围绕构成要件获取证据、比对“类型”不断修正、辨明案件事实的“实体形成”的思维过程。因此,有必要总结和梳理一些既有必要性也有可行性的刑事证明思维方法,为刑事案件证明提供思维能力上的支持。研究认为:要具备运用构成要件指导刑事证明的思维能力,运用构成要件对案件进行事实和证据判断;要具备结合中国法治传统和现阶段国际形势,运用法治思维和方式化解社会矛盾的能力;要具备运用逻辑思维快速处理普通案件和运用直觉思维精准解决疑难复杂案件的能力。

The process of proof of criminal cases is essentially a process of thinking around the constituent elements to obtain evidence,to compare the“types”and to“identify”the facts of the case.Therefore,it is necessary to summarize and sort out some criminal proof thinking methods that are both necessary and feasible,providing support for criminal case proof.It is necessary to have the ability to use the constituent elements to guide the criminal proof,and to use the various elements of the constituent elements to judge the case and evidence;to have the ability to combine the rule of law in China with the current international situation and use the rule of law to resolve social contradictions;to apply logical thinking to quickly deal with ordinary cases and use intuitive thinking to accurately solve difficult and complex cases.
