诊所法律教育面临的困境与应对思路——以江汉大学诊所课程教学为例

Solution to the Problems in Clinical Legal Education——Jianghan University as an Example

随着诊所法律教育的不断深入,面临的问题日趋凸显,比如学生出庭严格受限、"双师型"师资配备不足、办案经费缺乏保障以及如何与实务部门深度合作等问题,已经严重影响诊所教育的实际效果。着力打通地方法律援助机构与高校法律诊所对接通道,科学制定与地方法院、律所等实务部门联合育人培养方案,加强与地方企业、妇联、工会等单位开放办学,充分利用"卓越法律人才教育培养计划"项目优质资源,大胆引入人民调解委员会纠纷调处机制,通过这些有效措施,整合资源,不断创新和优化诊所教育模式,为国家法治建设培养更多高素质法律人才。

As clinical legal education proceeds step by step,several concerns have become apparent:strictly limited student presence at the court,inadequate number of qualified lawyer-teachers,insecure funding for case handling,and difficulties in cooperation with departments of legal practice.These setbacks have already negatively affected the current practice of clinical legal education.This paper recommends:strenuously open channels that connect local legal aid organizations and university legal clinics;design joint education programs with departments of legal practice such as courts and law firms;further open up classroom instructions to social entities such as enterprises,Women’s Federations,Labor Unions;fully utilize the resources provided by the"Educational Project for Outstanding Legal Professionals";and introduce the mechanism of disputes settlement exercised by the People’s Mediation Committees.Through these measures and by incorporating resources available and innovating and optimizing the models of instruction,clinical legal education will produce a greater number of highly-qualified legal professionals who will contribute to the nation’s rule of law.
