我国《经济法通则》研究的过去、现在与未来

The Past,Present and Future of the General Principles of Economic Law in China

在法典化的时代,面对各部门法的帝国主义及经济法领域内的分离运动和法系冲突难题,经济法的通则化主张再度兴起,其一定程度上可以看作是统一主义的反应。然而,截至目前四次有关《经济法通则》的讨论,依旧存在共识不足、理论准备不充分、立法推进乏力的问题。为此,在回顾过去,传承经济法前辈经济法通则化/法典化理想的同时,我们更应立足当下,把握未来,着重做好以下三个层面的工作:在立法定位方面,可以以《民法通则》为参照;在学术准备方面,可以将调制论作为方向选择;在立法准备方面,则应做好对既有经济单行法的评估与通则的制定、《经济法通则》的制定与各经济法板块基本法创制之间的"双重并进"。

In the era of codification,facing the imperialism of sectoral laws,the separation movement in the field of economic law and the conflict of legal systems,the generalization of economic law has risen again,which can be seen as a reaction of unification.However,up to the present four discussions on generalization of economic law,there are still some problems,such as insufficient consensus,insufficient theoretical preparation and weak legislative promotion.To this end,while inheriting the ideals of the generalization/codification of the economic law of the predecessors,we should do some job in the following three aspects.In the legislative positioning,we can refer to the general principles of civil law.In the academic preparation,we can choose the modulation theory as the direction.In the aspect of legislative preparation,we should do some job between the evaluation of the existing economic laws and the formulation of the generalization of economic law,at the same time,we should also do a good job between the formulation of the general principles of economic law and the formulation of the basic laws of various economic law plates.
