摘要
能否被认定为劳动法上的劳动者受到劳动基准保护,对于普通公民而言,具有极为重要的意义。劳动者作为劳动关系的主体,其判断标准一直与劳动关系的判断标准相捆绑。一方面,现行法律面临大量劳动者被排除在劳动关系之外却又需给予劳动基准保护的两难境地;另一方面,网络经济环境下越来越多的"准从属性"劳动者应否纳入劳动基准保护也成为热门话题。对劳动者的判断,应回归到"从属性"标准,并扩大非典型劳动关系中劳动者的认定范围;将"主体"标准作为劳动合同订立、解除的合法性判断条件,而非劳动关系的判断依据。
It is of great significance for ordinary citizens whether they can be recognized as laborers in labor law protected by labor standards.As the main body of labor relations,laborers judgment criterion has always been tied up with the criterion for judging labor relations.The current law is faced with the dilemma that a large number of laborers are excluded from labor relations but should be protected by labor standards.On the other hand,whether more and more"quasi-subordinate"workers are included in the protection of labor standards in the network economy environment has become a hot topic.The judgment of laborers should return to the criterion of"subordination"and expand the scope of laborers’identification in atypical labor relations.The criterion of"subject"should be used as the judgment condition of the legality of the conclusion and termination of labor contracts,rather than the judgment basis of labor relations.
