《医疗纠纷预防和处理条例》视野下医疗损害鉴定制度一元化求解路径的新思维

New Thinking on the Unification Solution Path of Medical Damage Identification System under the Perspective of the Regulation on the Prevention and Handling of Medical Disputes

长期存在的二元化医疗损害鉴定制度加剧了医疗损害案件的处理难度,影响了司法的权威,对于二元化医疗损害鉴定制度问题的一元化求解路径有颇多争议,也存在许多现实障碍。《医疗纠纷预防和处理条例》提出了从程序统一路径构建一元化医疗损害鉴定制度的新思路,颇具现实可操作性及指导价值。未来在一元化医疗损害鉴定制度构建中要注意通过设定鉴定人准入标准、统一规范鉴定指南和标准、发挥听证制度在鉴定中的作用、保障鉴定专家权益、规范鉴定规范收费等措施来完善。

The long-standing dualistic medical damage identification system has aggravated the difficulty of handling medical damage cases and affected the judicial authority.There are many disputes and practical obstacles in the unified solution of the dualistic medical damage identification system.The Regulation on the Prevention and Handling of Medical Disputes put forward a new thinking of building a unification medical damage identification system from the unification path of procedures,which is quite practical operability and guiding value.In the future,in the construction of unification medical damage identification system,attention should be paid to improving by setting the access standards of appraisers,formulating uniform standards and guidelines for appraisement,giving full play to the role of hearing system in identification,protecting the rights and interests of experts and standardizing the charges of identification.
