水电建设工程管理中分包风险防控的法治手段研究

Research on the Legal Means of Subcontract Risk Prevention and Control in Hydropower Project Management

全面依法治国的新形势下,依法治企、合法合规管理已成为企业管理的重要课题。其中,建设工程管理中由于分包乃至违法分包、转包、挂靠等情况带来的诉讼等法律风险长期困扰工程管理人员。本文从此切入,结合金沙江上游川藏段梯级电站建设过程中实践经验,探究建设单位在水电建设工程管理中分包风险预防手段、企业避险方式和管控预期效果,可为类似工程管理提供参考。

Under the new situation of comprehensively law-based governance of the country,it has become an important subject for enterprise management to govern the enterprise in accordance with the laws and rules.Among them,the legal risks caused by subcontracting,even illegal subcontracting,affiliation and other situations in project management have long puzzled project managers.From this point on,combined with the practical experience in the construction process of cascade hydropower station in Sichuan Tibet of the upper reaches of Jinsha River,this paper explores the construction enterprise's subcontract risk prevention means,enterprise risk avoidance methods and expected effect of management and control in hydropower project management,and tries to provide reference for similar project management.
