《区块链信息服务管理规定》之规范主体“区块链信息服务提供者”内涵宽泛,缺乏具体界定,原因之一系它对整个区块链立法规制对象的划分标准未予明确。从事物与行为的本质出发,区块链立法规制应包含三个维度——技术开发行为、代币交易行为及以区块链为技术手段的行为。基于相关立法体系视域下的信息服务意指范围,针对区块链技术本身的特性,结合监管目的与行业发展,对《规定》所指“区块链信息服务提供者”的主体范围与服务内容予以综合阐释。

The main subject of the Blockchain Information Service Management Regulations of the“blockchain information service provider”has broad connotation and lack of specific definition,one of the reasons is that the entire blockchain legislative regulatory object of the division of the standard is not clear.Starting from the nature of things and behavior,it is suggested that blockchain legislative regulation should contain three dimensions-technology development behavior,token trading behavior and blockchain-based behavior,and based on the scope of information services under the relevant legislative system,the characteristics of blockchain technology itself,combined with regulatory purposes and industry development,the Regulations of the“blockchain information service provider”is a comprehensive interpretation of the subject scope and service content.
