融媒体时代广播组织权制度向网络环境的延伸——基于WIPO版权与相关权常设委员会最新发展动向的分析

Extension of Broadcasting Organization Right System to Network Environment in the Age of Medium Integration——Interpretation of the Latest Development Trend of WIPO Permanent Committee on Copyright and Related Rights as an Opportunity

融媒体时代,传统广播组织权制度向网络环境延伸面临重重阻碍。从WIPO版权与相关权常设委员会最新发展动向及我国广播组织权制度的发展趋势来看,我国广播组织“转播权”的相关规定不必完全参照国际标准,因而在《著作权法修订草案(送审稿)》中扩张了广播组织转播权的范围,提出了专有权的设权模式,使得传统广播组织“转播权”向网络环境延伸具有相当的可行性。同时,我国相关广播主体的政策限制与《著作权法》私法规范的路径并行不悖,赋予网络广播组织邻接权保护与行政规制不存在明显冲突,不排除将利用计算机网络传输节目信号且符合实体要件的网络广播组织纳入广播组织范畴,以适应融媒体时代的发展需求。

In the era of financial media,the extension of traditional broadcasting organization right system to the network environment is facing many obstacles.Based on the latest development trend of WIPO Copyright and Related Rights Standing Committee and the analysis of the current situation of broadcasting organization right system in China,the provisions of broadcasting organization's"broadcasting right"in China should not refer entail to the international standards.The draft revised Copyright Law(for transmission and review)expands broadcasting organization's broadcasting right.It is feasible and necessary for traditional broadcasting organizations to extend their"broadcasting rights"to the network environment.At the same time,the policy limitation of the relevant broadcasting subjects in China is in line with the path of the private law regulation of the copyright law,giving no obvious conflict between the protection of the neighboring rights of the network broadcasting organizations and the administrative regulations.It does not exclude that the network broadcasting organizations that use the computer network to transmit the program signals and meet the substantive requirements are included in the broadcasting organization category to meet the development needs of the era of the fusion media.
