浅析赋予设区的市以地方立法权的价值、困境及出路

Entrusting Local Legislative Power to the City With Districts: Value,Difficulty,and Solutions

2015年十二届全国人大第三次会议决定对《立法法》进行修改,赋予了设区的市以立法权。随着改革的不断深入,以地方人大为主导的地方立法无法充分发挥作用,地方立法独立性受到影响,同时缺乏相关经验和人才。因此,可以通过完善人大职能主导立法,扩大民主参与渠道,加强事后监督等措施,使设区的市的地方立法权发挥应有的作用。

At the third session of the 12th National People’s Congress in 2015,it was decided to amend the legislative law,entrusting the city with districts the right to develop laws.With the deepening of reform,local legislation dominated by local People’s Congress cannot play its full role,the independence of local legislation is affected,and there is a lack of relevant experience and talents.Therefore,we can improve the function of the People’s Congress leading legislation,expand the channels of democratic participation,strengthen post supervision and other measures,so that the local legislative power of the city with districts can play its due role.
