摘要
作为为乡村提供公共法律服务,提升其治理能力和治理体系现代化、法治化水准的一项惠民性制度,村居法律顾问制度在实践运行中取得了一定社会功效,但同时也普遍陷入非可持续发展困境,在有的乡村,村居法律顾问制度甚至一定程度被虚置。村居法律顾问制度的配套制度建构不及时是造成其运行不畅的重要原因。村居法律顾问制度社会功效的充分激发及可持续发展亟待建构村居法律顾问退出制度、工作制度、考核奖惩制度和经费保障制度。只有如此,村居法律顾问制度才可能与配套制度一道形成制度合力,真正实现村居法律顾问制度设置的目的。
In order to provide public legal service for the village and enhance its governance capacity and legalization level,the village legal counsel system has achieved certain social effects in practice,but also face the clilemma of-sustainable development.In some villages,the legal counsel system of villages is even squandered to a certain extent.The follow-up of the construction of the supporting system of the village legal counsel system is an important reason for its poor operation.The full stimulation and sustainable development of the social effectiveness of the village legal counsel system urgently requires the construction of the village legal counsel exit system,work system,assessment reward and punishment system,and funding guarantee system.Only in this way,the village legal counsel system can work together with its supporting system and realize the purpose of setting up the village legal counsel system.
