从两则案例析英国未成年患者知情同意权的行使

Analysis of the exercise of informed consent of underage patients in the UK via two cases

未成年患者知情同意权的行使具有特殊性与复杂性。一方面未成年患者是知情同意权的享有主体;另一方面其知情同意权行使中可能需要监护人(主要是父母)的介入,其中就会产生未成年患者医疗决定权、隐私权与父母的监护权关系如何处理的问题。我国当前未成年患者知情同意权的行使存在立法保障不足,难以满足未成年患者的最佳利益保护。文章结合英国Gillick、Sue Axon案,比较分析英国未成年患者知情同意权的行使与保障,以期对我国未成年患者知情同意权保障有一定借鉴意义。

The exercise of informed consent right of underage patients is special and complex.On the one hand,underage patients are the main body of informed consent right,on the other hand,they need the intervention of guardians(mainly parents)in the exercise of informed consent right.At present,there is no sufficient legislative guarantee and relief system for the exercise of the right of informed consent of underage patients in our country,so it is difficult to meet the best protection of the interests of underage patients.Based on the case of Gillick,Sue Axon in the United Kingdom,this paper compared and analyzed the exercise and protection of the right of informed consent of underage patients in the United Kingdom,in order to provide some reference significance for the protection of the right of informed consent of underage patients in China.
