解剖尸体立法刻不容缓

Adapt to the times need to promote national health:strengthening the legislation of autopsy urgently

2019年是原卫生部重新发布试行《解剖尸体规则》40周年。但40年来我国发生了翻天地覆的变化,这个规则的条款不全,部分内容明显滞后,已远远不能适应我国现代社会发展、全面依法治国和实施健康中国战略的需要。加上没有解剖尸体方面的法律明显影响到解剖尸体工作的开展,因此我国解剖尸体立法刻不容缓。不仅对做好解剖尸体工作、提高死因鉴定和司法鉴定质量具有非常重要的理论和实际意义,而且对填补我国这一法律空白,完善国家卫生法律体系,落实全面依法治国,促进我国医学发展和全民健康均具有十分重要的意义。建议国家积极组织有关部门研究和起草《解剖尸体法》,变部门行规为国家法律并做到四个相结合。

2019 marks the 40 th anniversary of"The Autopsy Regulation",which reissued by the original Ministry of Health.However,during the past 40 years,tremendous changes have taken place in China,and this regulation lags behind obviously.It is far from meeting the needs of the development of modern society,the comprehensive rule of law and the implementation of the healthy China strategy.The absence of a complete and clear laws on autopsy has significantly affected the conduct of this work.Therefore,it is very urgent to strengthen our autopsy legislation work,which not only has very important theoretical and practical significance to do a good job and improve identification quality in the cause of death and judicial appraisal but also has very vital significance to fill this law gap in our country,improve the state of the health legal system,implement fully the rule of law and promote the development of our country′s medical and the national health.It is suggested that the state should actively organize relevant departments to study and draft"The Autopsy Law"and change the departmental regulations of The Ministry of Health into The National Law and achieve the combination of four aspects.
