对一起无卫生许可证生产经营消毒产品案件的思考

Analysis and consideration on a disinfection product case of production and operation without production enterprise′s sanitary license

介绍一起无卫生许可证生产经营消毒产品案查处过程,为卫生执法人员办理此类案件提供参考。同时对"零口供"行政处罚、卫生用品许可的法律依据、消毒产品许可分类目录合理性等进行探讨,提出进一步完善法律、规范监督执法,从而规范消毒产品市场管理的建议。

This paper introduced the investigation and disposal process of a case of producing and operating disinfection products without a production enterprise′s health license,which provided a reference for health law enforcement personnel in handling such cases.At the same time,the administrative penalty of"zero confession",the legal basis of sanitary products licensing and the rationality of the classification catalogue of disinfection products licensing were discussed,and some suggestions were put forward to further improve laws and regulations,standardize supervision and law enforcement,so as to standardize the market management of disinfection products.
