Study on Property-Related Crime in the Background of a New Type of Online Payment

随着网络技术的迅猛发展,网络支付逐步取代传统支付技术,成为人们日常生活中新型交易常态。与之俱来的是新型网络侵财犯罪的高发,此类犯罪具有犯罪手段新颖、行为定性困难的特点。通过实证研究,归纳总结出网络支付侵财犯罪主要的犯罪类型及行为特征,同时明晰并厘清存在的争议焦点,确立不同犯罪行为的刑法规制方式,最终可以提供相应的侦查对策和犯罪预防建议。

With the rapid development of Internet technology,online payment has gradually replaced traditional payment,which has become a new but routine business activity in daily life.Along with it comes the high incidence rate of new online property crime.Criminals of such kind use new criminal methods,which has difficulty determining the nature of their behaviors.By studying real cases,the writer has concluded the types and characteristics of such crime and meanwhile,made clear the controversial points,established criminal law provisions to deal with different criminal behaviors and finally suggested criminal investigation and crime prevention countermeasures.
