监察体制改革与刑事司法体制改革相协调的立法需求

Legislative Demands of Coordination between Reform of the Supervisory System and Reform of Criminal Justice System

监察体制改革与刑事司法体制改革都是在全面推进依法治国的大背景下开展的。本文运用系统方法,既将监察、检察与审判三机关看作国家治理体系(国家治理系统)中的不同要素予以分析,又尊重和重视监察、检察与审判三机关作为独立子系统的运行规律,并在此基础上提出监察体制改革与刑事司法体制改革均应在党的统一领导下,切实将公正、法治等社会主义核心价值观融入监察法律法规完善和刑事司法体制改革的立法当中,以巩固"以审判为中心"的刑事司法改革成果,保障已由宪法和法律稳固了的国家治理系统内部结构科学有序、协调稳定,外部目标协调一致,功能整体最优的运行机制。

Reform of the supervisory system and reform of the criminal justice system are all carried out against the background of comprehensively advancing the rule of law in China.This paper is developed based on a system method.It not only analyzes the three institutions of the National Supervisory Commission,the People’s Procuratorate and the People’s Court as different elements in the national governance system,but also considers them as independent subsystems and pays attention to the importance to their operation rules.On this basis,this paper proposes that both reform of the supervision system and the reform of the criminal justice system should be under the unified leadership of the China Communist Party,and it should integrate core socialist values such as fairness and the rule of law into legislation to improve the reforms.Moreover,it should use the achievements of the"Trail-Centered"criminal justice reform to ensure that the internal structure of the national governance system,which has been solidified by the constitution and laws,is scientific and orderly,coordinated and stable,with coordinated external objectives and optimal overall functions.
