网络平台垄断势力识别及规制研究

Research on the Identification and Regulation of Monopoly Power of Network Platform

随着互联网经济的迅速发展,网络平台经济逐渐兴起,但网络平台日益趋向“一家独大”的垄断趋势。本文旨在寻找依托于双边市场的网络平台垄断势力识别方法,对传统的替代性分析方法和SSNIP测试进行了改进,并提出了盈利模式测试法。最后得出网络平台垄断规制思路:把握创新与垄断平衡、保持对相关理论的开放以及反垄断法要以必要为前提并加强承诺制度。

With the rapid development of the Internet economy,the network platform economy is gradually rising,but the network platform is increasingly trending toward the only one monopoly.This paper aims to find a method to identify the monopoly power of network platforms relying on bilateral market,trying to improve traditional alternative analysis methods,SSNIP testing and Profit Model Test.Finally,the idea of monopoly regulation of network platform is drawn:keeping the balance between innovation and monopoly,maintaining the open to the relevant theories and necessity of antitrust law as a premise and strengthening the commitment system.
