行政执法信息公示制度脱困研究

A Study on Information Publicity System of the Administrative Law Enforcement

行政执法信息公示制度的设立初衷在于彰显执法的规范和透明,进而促使行政相对人更加守法诚信。但是,随着这一制度的运行,行政执法信息公示对行政相对人带来诸多负面影响,甚至有异化为二次处罚的趋势。分析行政执法信息公示制度变异的原因,主要有执法政策的影响、相关领域原则与规则的阙如、黑名单泛化等因素。与此相对应,厘清法律与政策的关系、完善公示制度的原则、规范黑名单制度的运行将会助推行政执法信息公示制度走出困局。

The original intention of the establishment of the administrative law enforcement information disclosure system was to highlight the norms and transparency of law enforcement,and then to promote the administrative counterpart to be more law-abiding and honest.However,with the operation of this system,the disclosure of administrative law enforcement information has many negative impacts on administrative counterparts,and even has a tendency to alienate into secondary punishment.This paper analyzes the reasons for the variation of administrative law enforcement information publicity system,mainly including the influence of law enforcement policy,the lack of principles and rules in related fields,and the generalization of blacklist.Accordingly,to clarify the relationship between law and policy,to improve the principle of publicity system,and to standardize the operation of blacklist system will help the administrative law enforcement information publicity system out of the dilemma.
