摘要
印度残疾人版权例外制度极大地保障了残疾人参与文化生活的权利,包括残疾人合理使用例外和残疾人利益强制许可两大部分。残疾人合理使用例外允许以无障碍格式版对任何作品进行改编、复制、发行或向公众传播,残疾人利益强制许可则允许营利性地以任何对残疾人有利的无障碍格式版出版任何作品。我国也是拥有庞大残疾人群体的发展中国家,故可借鉴印度在该方面的有益经验,扩大残疾人版权例外的适用范围,以充分保障我国残疾人获取和使用作品的权利。
The disability exception in Indian Copyright Act greatly guarantees the right of disabled to participate in cultural life.It includes two parts:the fair dealing exception for disabled and the compulsory license for benefit of disabled.The fair dealing exception for disabled allows adaptation,reproduction,issue of copies or communication to the public of any work in any accessible format.The compulsory license for benefit of disabled allows for-profit publishing any work in any format useful for person with disability.China,which is also a developing country with a large group of disabled,should learn from India’s approach in this regard and expand the scope of application of copyright exceptions for disabled to protect the rights of disabled to obtain and use works.
