我国地理标志保护规则困境及体系协调路径研究

The Dilemma of the Protection Rules of Geographical Indication in China and the Study of the Approach to Coordinate the Systems

在地理标志复合保护模式下,我国立法并未形成协调统一的保护体系,因而对地理标志保护的权利边界界定困难,进而引发条款含义模糊、适用标准不统一等诸多问题。我国开展完善立法工作应当借鉴《日内瓦文本》中系统化的协调保护模式,纵向构建多层次地理标志统一保护框架,确定地理标志在同类产品上使用的绝对保护标准与在非同类产品上使用的相对保护标准,并横向完善地理标志与商标权利冲突解决方式,在权利共存的基础上,明确并细化“避免混淆”“遵循诚实信用原则”等共存前提。

There is no coordinated and unified protection system under the compound protection mode of geographical indications in China.So,it is difficult to define the right boundary of the protection to geographical indications,which leads to many problems,such as ambiguous terms and inconsistent applicable standards.By referring to the way of the Geneva Act to coordinate different protection modes of geographical indications systematically,a vertical multi-level unified protection framework for geographical indications should be built,the absolute protection standard of geographical indications used in similar products and the relative protection standard of geographical indications used in non-similar products should be determined.We also should improve the solution of conflicts between geographical indications and trademark rights horizontally.On the basis of coexistence of rights,the premises such as“avoiding confusion”and“adhering to the principle of good faith”should be clarified and refined.
